CAPITAL LEVY

The Board of Directors of Seattle School District No. 1 passed Resolution No. 2003-29 concerning this proposition to fund the Buildings, Technology, and Academics II Program. This proposition authorizes the District to levy the following excess taxes, to replace the expiring Buildings, Technology, and Academics I levy, on all taxable property within the District, for construction and modernization of educational facilities throughout the District:

EXPLANATORY STATEMENT

Passage of Proposition No. 2 would allow Seattle School District No. 1 (the "District") to levy excess taxes, in place of an expiring capital levy, to provide a total of $178 million for the District's Capital Projects Fund for improvements to meet the current and future educational program needs of its students. If approved, said levies will be made for the six years commencing in 2004 for collection in the school years 2004-2005 through 2009-2010. The estimated tax rates range from approximately $.33 per one thousand dollars to be collected in 2006 to approximately $.25 per one thousand dollars of assessed valuation to be collected in 2010.

The $178 million will fund the construction, remodeling and modernization of the District's educational facilities throughout the District. These projects shall include building reinvestments, including roof replacements, mechanical systems and interior and exterior renovations, life safety and ADA compliance, acquisition of technology and technical infrastructure, including internet wiring and administrative systems, and the construction, remodeling and modernization of libraries and science facilities, auditorium and art facilities improvements, playgrounds and synthetic athletic fields and other academic facilities and other Capital Fund expenditures as may be found necessary by the District's Board of Directors. Levy proceeds may only be used to support the construction, modernization, replacement and remodeling of school facilities, including the implementation of the District's technology facilities plans.

STATEMENT AGAINST

Children need safe, positive learning environments to reach their potential. Proposition #2 renews our commitment to provide Seattle's school children with safe, secure, modern schools. Vote YES for the capital levy which addresses basic safety concerns: replacing old roofs and updating fire alarms and sprinkler systems in desperate need of repair. The levy will also improve science labs and update technology and libraries throughout the district.

The Capital levy is NOT a new tax. Property owners will pay the same amount we already pay to upgrade safety, security, and technology in our public schools.

Voting yes to renew the expiring levy demonstrates our commitment to helping students achieve and the role that science, literacy, music, the arts and athletics play in every child's education. Better and safer school buildings also contribute to community pride, strong, healthy neighborhoods and a high quality of life.

Renewing the capital levy ensures that every student have the best possible environment for learning and the best possible chance for a good education.

NOTE: The new minimum turnout law now applies only to "Yes" votes. To defeat this levy, you have to vote NO - you can't just stay home.

Please vote NO on Proposition Two, the $178 million Capital levy. Capital levies don't pay teachers: a NO vote won't cut teachers, just waste. This levy comes from the OLD School Board; now is not the time to pour new money into bad budgets.

Money is leaking to cover the $32 million cost overrun from the District's new headquarters. (See "Let's Check Their Math," Seattle Weekly, October 29, 2003; www.seattleweekly.com)
Money is leaking to cover Building Excellence I construction cost overruns above $2 million, yet no independent oversight is proposed for Proposition Two.

New money would leak to the privately-funded New School, which would displace South Lake High School.

New money would leak to cover adult-use athletic field maintenance.

New money would leak to the Montlake school building which artificially caps its capacity, keeping out neighborhood kids.

"Business as usual" will destroy our Landmark schools, like Roosevelt ($84 million of destruction / summer 2004), Garfield, and Cleveland. Instead, the District should use major savings from reduced demolition to add portables and shorten wait-lists at popular schools; transfer capital interest earnings to halt school budget cuts, support Proyecto Saber, South Pacific Islander programs, APP, Spectrum, fix school water quality, etc.

REBUTTAL OF STATEMENT AGAINST

The Seattle School Board, old and new, has endorsed these levies. Replacing old roofs and updating fire alarms are critical to keep our children safe. Projects from the 1998 levies were completed on time and on budget. Seattle schools are making great progress and we need to build on this by renewing the levies, ensuring that every student receives the best possible chance for a good education. 47,000 kids need your help. Please vote YES.

A RESOLUTION of the Board of Directors of Seattle School District No. 1, King County, Washington, providing for the submission to the qualified electors of the district at a special election to be held therein on February 3, 2004, of a proposition to authorize the district to levy an additional tax to provide a total of $178 million for the District’s Capital Projects Fund for construction, replacement, renovation, improvements and expansion of new and existing facilities, and for technology improvements, equipment and training, to meet the current and future educational programs for its students, such levies to be made for six years commencing in 2004 for collection in the school years from 2004-2005 through 2010-2011.

WHEREAS, the educational facilities of Seattle School District No. 1, King County, Washington (the “District”), including technology facilities are in need of renovation, construction, improvements and expansion to meet the current and future educational programs for its students; and

WHEREAS, funds available to the District will be insufficient to enable the District to implement such projects; and

WHEREAS, in order to support the cost of these projects as found necessary by the Board of Directors, it is deemed advisable that the District levy a tax upon all the taxable property within the District in excess of the annual tax the District is permitted by law to levy without a vote of the people, such levy to be made for six years commencing in 2004 for collection in the school years from 2004-2005 through 2010-2011, inclusive, as authorized by Article VII, Section 2 of the State Constitution and RCW 84.52.053; and

WHEREAS, the question of whether or not such excess tax may be levied must be submitted to the qualified electors of the District for their ratification or rejection; and
WHEREAS, the conditions here and above set forth create an emergency which requires the holding of a special election in the District;

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF SEATTLE SCHOOL DISTRICT NO. 1, KING COUNTY, WASHINGTON as follows:

Section 1. Finding. It is hereby found and declared that the welfare of the students and other residents of the District requires the District to carry out the plans hereinafter provided.

Section 2. Authorization of Construction, Remodeling and Modernization. The District shall construct, remodel and modernize its educational facilities throughout the District. These projects shall include building reinvestments, including roof replacements, mechanical systems and interior and exterior renovations, life safety and ADA compliance, acquisition of technology and technical infrastructure, including internet wiring and administrative systems, and the construction, remodeling and modernization of libraries and science facilities, auditorium and art facilities improvements, playgrounds and athletic fields and other academic facilities and other Capital Fund expenditures as may be found necessary by the Board of Directors.

The District may repay any obligations hereafter incurred for the foregoing purposes.

If available funds are sufficient, the District shall acquire, construct, equip and make other capital improvements to the facilities of the District, all as the Board of Directors finds necessary; provided that such funds may be used only to support the construction, modernization, replacement, and remodeling of school facilities or implementation of the District’s technology facilities plan.

If the District shall determine that it has become impracticable to accomplish any of such improvements or portions thereof by reason of changed conditions or needs, incompatible development, costs substantially in excess of those estimated, or acquisition by a superior governmental authority, the District shall not be required to accomplish such improvement and may apply levy proceeds as set forth in this section. If any or all of the improvements have been completed, or their completion duly provided for, or their completion found to be impractical, the District may apply the levy proceeds or any portion thereof to other portions of the improvements or to other capital purposes of the District, as the District in its discretion shall determine. Notwithstanding any provision of this resolution to the contrary, levy proceeds may only be used to support the construction, modernization or remodeling of school facilities or implementation of the District’s technology facilities plan.

Section 3. Authorization of Levies. It is hereby found and declared that an emergency exists requiring the submission to the qualified electors of the District of the proposition whether the District shall make the Capital Projects Fund levies for their ratification or rejection at a special election to be held on February 3, 2004. For the purpose of providing funds necessary for the needs described in Section 2 above, the King County Records and Elections Division, as ex-officio supervisor of elections in King County, is hereby requested to find the existence of such an emergency and to call and conduct such special election to be held within the District on such day and to submit to the qualified electors of the District for their approval or rejection, a proposition providing for tax levies for the Capital Projects Fund for six years, commencing in 2004, producing dollar amounts at estimated tax rates per thousand dollars of assessed value to produce such amounts, in excess of the maximum amount tax levy permitted by law to be levied within the District without a vote of the electors, all as follows:

  1. A tax of approximately $.33 per one thousand dollars of assessed valuation to
    provide $29,666,666, said levy to be made in 2004 for collection in 2005;
  2. A tax of approximately $.31 per one thousand dollars of assessed valuation to
    provide $29,666,666, said levy to be made in 2005 for collection in 2006;
  3. A tax of approximately $.30 per one thousand dollars of assessed valuation to
    provide $29,666,667, said levy to be made in 2006 for collection in 2007;
  4. A tax of approximately $.28 per one thousand dollars of assessed valuation to
    provide $29,666,667, said levy to be made in 2007 for collection in 2008;
  5. A tax of approximately $.26 per one thousand dollars of assessed valuation to
    provide $29,666,667, said levy to be made in 2008 for collection in 2009; and
  6. A tax of approximately $.25 per one thousand dollars of assessed valuation to
    provide $29,666,667, said levy to be made in 2009 for collection in 2010.

Section 4. The Secretary of the Board of Directors is hereby authorized and directed to certify said proposition to the King County Records and Elections Division, as ex-officio supervisor of elections in King County, substantially in the following form:
