AN ORDINANCE establishing August 19, 2008, as the date of a special election on the question of annexation to fire district 50 of the town of Skykomish; and declaring an emergency.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. Fire district 50, by Resolution No. 08-01, has determined that it is in the best interests of the district and the public to include the town of Skykomish, in accordance with chapter 52.04 RCW.
B. The town of Skykomish, by Ordinance No. 387, showed its intent to join fire district 50 and found that the public interest would be served thereby.
C. The King County boundary review board received a request for review under chapter 36.93 RCW, and on May 10, 2008, the review board, in file 2276, deemed the proposed annexation approved.
E. Pursuant to chapters 29A.04 and 52.04 RCW, the metropolitan King County council deems an emergency exists for the purpose of calling a special election to be held on the question of this annexation on August 19, 2008.
SECTION 2. A special election shall be held on the 19th day of August 2008 in accordance with chapter 35A.14 RCW within the territory of fire district 50 and the town of Skykomish, for the purpose of submitting the question of annexation of the town of Skykomish into fire district 50.
SECTION 3. The number of residents within the town of Skykomish is estimated at two hundred ten as nearly as may be determined from available records. The number of residents in the territory of fire district 50 is estimated at one thousand and two hundred as nearly as may be determined from available records.
SECTION 4. Pursuant to RCW 29A.04.321 and 52.04.071, it is hereby deemed that an emergency exists for purposes of calling a special election. The King County director of the elections division is hereby requested to assume jurisdiction to call and conduct a special election and submit to the registered voters within the town of Skykomish and the territory of fire district 50 of the proposition as set forth in section 4 of this ordinance. The clerk of the council is hereby authorized and directed to transmit the proposition to the director of the elections division in substantially the following form, with such additions, deletions or modifications in the ballot title as may be required for the propositions listed below by the King County prosecutor:
PROPOSITION 1: Fire District 50 passed Resolution No. 08-01 and the town of Skykomish passed Resolution No. 387 both concerning annexation of the town of Skykomish into Fire District 50. Shall the town of Skykomish be annexed to and be a part of fire protection district 50?

SECTION 5. The director of the elections division is hereby authorized and requested to prepare and distribute a local voters’ pamphlet, pursuant to K.C.C. 1.10.010, for the special election called for in this ordinance, the cost of the pamphlet to be included as part of the cost of the special election.
SECTION 6. A. The boundaries of the territory proposed for annexation are hereby described in Attachment A to this ordinance.
B. The boundaries of fire district 50 are hereby described in Attachment B to this ordinance.
SECTION 7. The council finds as a fact and declares that an emergency exists and that this ordinance is necessary for the immediate preservation of public peace, health or safety or for the support of county government and its existing public institutions.

Commencing at the existing concrete monument, on centerline Station 844+39.9 P.C. shown on drawing Sheet 3 of 8 Sheets of Contract drawings for State Road No. 2, Stevens Pass Auto Camp to Money Creek Park; Thence Southwesterly along said centerline and along a curve to the right having a radius 1910.00 feet, through a central angle of 1°47’39”, an arc distance of 59.81 feet;
Thence South 28°35’21” East along a radial line to said curve 50.00 feet to the South right-of-way margin of said SR 2, also Known as State Road no. 15 Northeast Stevens Pass Highway, as Conveyed to the State of Washington by deed recorded under Recording Number 2920989, records of King County, Washington and being a point on the East line of a tract of land conveyed To J.G. Henry and E.R. Dubuque under Recording Number 4076078, Records of King County, Washington, and the TRUE POINT OF BEGINNING;

That the name and number of said district shall be King County Fire Protection District No. 50, the boundaries of which shall be as follows:
Beginning at the northwest corner section 3, T. 26 N., R. 10 E., W.M., thence southerly along the west section lines of sections 3, 10, 15, 22, 27, 34 to the southwest corner of section 34, T. 26 N., R. 10 E., W.M., thence east along the township line between Townships 25 N. and 26 N. to the King-Chelan County line, thence north along the King-Chelan County line to the King-Snohomish County line, thence west along the King-Snohomish County line to point of Beginning, EXCEPT that area within the corporate limits of the Town of Skykomish.
